1. Agreement to these terms
These Terms and Conditions govern purchases and bookings made with Kiaan Technology Solutions Ltd. (“Kiaan,” “we,” “us,” or “our”). By completing a purchase, the person buying the course (“customer”) confirms that they have reviewed the course description, total price, delivery details, Refund and Cancellation Policy, Privacy Policy, and these terms.
If a customer buys training for another learner, the customer is responsible for providing these terms to that learner. A learner under the age of majority must have a parent or legal guardian make or approve the purchase.
2. Courses and learning outcomes
We offer only the courses identified on our website or booking materials. A course description may identify topics, prerequisites, duration, format, schedule, included materials, and intended skill level. Learning outcomes depend on attendance, participation, prior experience, and practice; we do not guarantee employment, certification, earnings, grades, or a specific level of proficiency.
3. Orders, prices, and payment
The total price, applicable taxes, currency, accepted payment methods, and any additional charges will be disclosed before the customer submits an order. An order is not accepted until we provide written confirmation. Customers must provide accurate contact and billing information and must be authorized to use the selected payment method.
If a price or course detail contains an obvious error, we may cancel the affected order and provide a full refund rather than deliver the course on the erroneous terms.
4. Course delivery
Training may be delivered online, in person, one-to-one, or in a small group as stated at purchase. Online learners are responsible for a suitable internet connection, compatible equipment, and a safe location. In-person learners must follow reasonable location and safety rules provided before the session.
Access instructions and scheduling details will be sent using the contact information supplied by the customer. Customers should contact us promptly if confirmation is not received.
5. Cancellations, refunds, and schedule changes
Our Refund and Cancellation Policy forms part of these terms. It explains customer cancellations, missed sessions, rescheduling, refunds, and cancellations by Kiaan. Nothing in that policy limits cancellation or refund rights provided by applicable law.
6. Learner responsibilities and conduct
- Attend on time and participate respectfully.
- Do not record a session without written permission.
- Do not share access links or paid materials with another person.
- Do not use training sessions for unlawful, harmful, abusive, or disruptive activity.
- Back up important files before using a personal device during training.
We may remove a learner whose conduct creates a safety risk, seriously disrupts training, infringes rights, or remains abusive after a warning. Refund eligibility in that situation will be assessed fairly and subject to applicable law.
7. Course materials and intellectual property
Course notes, exercises, presentations, recordings, and other materials supplied by Kiaan are owned by Kiaan or used with permission. Unless we state otherwise, the learner receives a personal, non-transferable licence to use supplied materials for their own learning. Materials may not be resold, publicly posted, copied for a group, or used to deliver competing training without written permission.
Microsoft, Windows, Word, Excel, and PowerPoint are trademarks of their respective owners. Kiaan is not represented as being affiliated with or endorsed by Microsoft unless expressly stated.
8. Privacy and communications
Personal information is handled according to our Privacy Policy. Transactional messages about a booking may be sent as needed to deliver the service. Marketing messages will only be sent where permitted by law, and recipients may unsubscribe.
9. Disclaimers and limitation of liability
Courses are educational services. We use reasonable care in preparing and delivering training, but software features and third-party services may change. To the extent permitted by law, Kiaan is not responsible for indirect, incidental, or consequential losses, loss of data, lost profits, or losses caused by a learner’s equipment, internet service, third-party software, or failure to follow instructions.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law. Nothing in these terms excludes liability for fraud, wilful misconduct, gross negligence where it cannot be excluded, or any right or remedy that cannot lawfully be limited.
10. Events outside reasonable control
We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, widespread service interruption, public emergency, illness, or venue closure. We will make reasonable efforts to reschedule or provide another appropriate remedy.
11. Complaints and disputes
Please contact us first so we can try to resolve a concern. These terms do not prevent a customer from using rights or remedies available under consumer-protection law, contacting a regulator, posting a lawful review, or bringing a claim in a court with jurisdiction.
12. Governing law
These terms are governed by the laws of Alberta and the applicable laws of Canada. Subject to mandatory consumer rights, disputes may be brought before the courts of Alberta. If any provision is unenforceable, the remaining provisions continue to apply.
13. Changes to these terms
The terms accepted at the time of purchase govern that purchase. We may update these website terms for future purchases by publishing a new version and revision date.
